Final Orders & Holiday Visitation

My name is Allison Walley. I am the associate attorney here at the Gilmore Law Firm, today we’re going to talk about final orders and what happens after a divorce and custody proceedings have finished in court, either by agreement or by judge’s order. It’s important that you read through the entire agreement and final order in order that you understand and which kind of curtail questions or problems that arise in the future, specifically holiday visitation when the holidays roll around.

We like to take off time, and I know everybody likes to enjoy that time with their families. But holiday visitation is one of the main issues that I see as far as final orders and problems arising. So it’s important to always read through the agreement. You understand when weekend visitation terminates and holiday visitation picks up. This will help to avoid issues such as contempt, not having the children at the right pick up time, drop off the time and issues to avoid after holiday visitation.

But it’s also important to note that any unwritten changes cannot be enforced regarding you or your ex-spouse. Talk to one another and agree that, you know, these are the changes that you want to make, there is no way for a judge to be able to enforce those. You have to be very careful whenever it comes to unwritten changes. We want to make sure that you follow a final order exactly to the T to avoid issues such as contempt.
